pgnApp – General Terms and Conditions

A. General regulations

1. Scope of application

These General Terms and Conditions (GTC) apply to all deliveries and services of pgnApp, Klaus Knopf, Lammstr. 9, 76437 Rastatt (hereinafter referred to as pgnApp) to consumers A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity.

2. Contracting party

The purchase contract is concluded with pgnApp, owner: Klaus Knopf, Lammstr 9, 76437 Rastatt

3. Conclusion of contract

  1. The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order.
  2. By clicking on the button “order for a fee” you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.
  3. For products that are not ordered via the web store, the order signed by the customer is a binding offer that pgnApp can accept within two weeks by sending an order confirmation.

4. Right of withdrawal

  1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
  2. If you have requested that the services should commence during the withdrawal period or have made use of them, you shall pay us a reasonable amount corresponding to the proportion of the services already provided by the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
  3. In all other respects, the right of withdrawal is governed by the provisions set out in detail in the following.

    Cancellation policy

    Right of withdrawal
    You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise the right to cancel, you must inform us (pgnApp Klaus Knopf, Lammstr. 9, 76437 Rastatt, E-Mail: klaus.knopf@t-online.de, Phone: +49 177 912 5062) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory. You can also fill out and submit the sample withdrawal form or another clear declaration electronically on our website (insert Internet address). If you make use of this option, we will send you a confirmation of receipt of such a revocation without delay (e.g. by e-mail). To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

    Consequences of withdrawal
    If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

    You must return or hand over the goods to us or to (insert the name and address of the person authorized by you to receive the goods, if applicable) immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

    You shall bear the direct costs of returning the goods or the documents provided for the provision of the service.

    You will only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

    If you have requested that the services should commence during the withdrawal period or have made use of them, you shall pay us a reasonable amount corresponding to the proportion of the services already provided by the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

5. Prices and shipping costs

The prices stated on the product pages include VAT and other price components.

6. Delivery

  1. The delivery time in the online store is up to 3 days. We point out any deviating delivery times on the respective product page.
  2. b. The delivery time for goods and services that go beyond the provision of software (e.g. the recording of games by pgnApp) is up to 14 days, unless otherwise stated in the product description.

7. Payment

Payment can be made by credit card (Visa and MasterCard), PayPal or voucher.

8. Retention of title

The goods remain our property until full payment has been made.

9. Dispute resolution

The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

B. Special regulations for the conversion of chess forms into pgn

1. Limitation of performance

The conversion of chess forms by pgnApp – regardless of whether this is software-supported or manual – cannot be guaranteed to be completely correct. The pgn format may contain incorrect moves and/or be incomplete.

2. Prerequisites

The following requirements must be met for the conversion of chess forms:

  1. The form must correspond to a standard chess form.
  2. The game was recorded according to the “Algebraic Notation” described by FIDE.
  3. The notation language (abbreviations for the figures) is available in the pgnApp software.
  4. No additional notations, dashes etc. on the form.
  5. The notation is clearly legible and within the designated cells of the form.
  6. If the chess form is submitted as an electronic image, a resolution of at least 200 dpi is required and in color, without wrinkles and on a monochrome dark background.
  7. If there are several forms per player, they must be entered in the correct order.

3. Upload of data

Only the upload of chess forms or pgn files with master data is permitted. Violations may result in the user being blocked. pgnApp accepts no responsibility for the content of the files that are uploaded.
